Terms of use
The terms of use of the Etkivent platform: account, roles, bookings, quotes, payments, credits and liability.
Last updated: October 25, 2026
1. Purpose
These terms of use (the "Terms") govern access to and use of the Etkivent platform (the "Service"), available at etkivent.io and its subdomains, operated by its publisher (the "Publisher"). The Service connects private event organizers, vendors and event planners, and provides tools for planning, guest management, booking requests, quotes, invoicing and payment.
By creating an account or using the Service, you accept these Terms without reservation. If you do not accept them, you must not use the Service. The public vendor directory and guest reply pages are available without an account; using them implies acceptance of the sections that apply to them.
2. Account and roles
Signing up requires a valid email address, which you confirm through the link you receive, and a password. You choose a role at sign-up: organizer (you organize your own events), vendor (you offer services) or event planner (you organize events for your clients). Each role gives access to its own space and features; the role cannot be changed after sign-up except on request to the Publisher.
You are responsible for keeping your credentials confidential and for any activity carried out from your account. Report any unauthorized use without delay to the address given in the legal notice.
The Service is reserved for adults. Vendors and event planners act in the course of their professional activity and warrant the accuracy of the business information they declare (company name, registration number, address).
3. Intermediary role
Etkivent is a technical intermediary. Services booked through the Service are contracted directly between the organizer (or the event planner acting for their client) and the vendor. The Publisher is not a party to any service contract and does not guarantee the performance, quality or compliance of the services.
Each vendor is solely responsible for the information published on their profile, their availability, their quotes, their invoices and their compliance with legal, social and tax obligations. Any ratings and reviews reflect the opinion of their authors.
The directory also shows "Unverified" listings, created from public data (the INSEE SIRENE database, OpenStreetMap) for businesses that do not have an Etkivent account. These businesses are not Etkivent partners. No request, quote or booking can be sent to them through the platform. Etkivent does not guarantee that these listings are accurate or up to date, and is not a party to any relationship you establish directly with them. A business can claim or remove its listing at any time (see "Where do these listings come from?").
4. Bookings, quotes and invoices
A booking request sent to a vendor from an event is not an order: it binds the parties when the vendor accepts it, then when the quote is signed. Electronically signing a quote in the Service (checkbox, name and date) constitutes acceptance of its content and conditions.
Quotes and invoices issued through the Service bind the vendor or event planner who issues them; the issuer is their author and solely responsible for them with regard to accounting and tax obligations. The Publisher provides the editing tool, numbering and archiving, and keeps the documents for the legal retention period.
The organizer may cancel a request as long as it has not been accepted. After acceptance, cancellation conditions are those agreed between the parties in the quote; failing that, each party informs the other without delay through the Service's messaging.
5. Payments and credits
Online payments are processed by Stripe, a licensed payment service provider, through Stripe Connect: funds are paid directly into the vendor's Stripe account, the Publisher never holds the funds and stores no card data. As long as online payment is not enabled for an invoice, the vendor may mark it as paid outside the Service, under their own responsibility.
The Service is free for organizers. Credits, granted at sign-up or purchased in packs, unlock certain high-value features such as AI plan generation; ordinary use of the tool never consumes credits. Each charged action, its cost and your balance are shown before confirmation. Credits have no monetary value and are neither refundable nor transferable, unless the law provides otherwise.
Credit packs are digital content delivered immediately: by purchasing a pack, you request its immediate performance and expressly waive your right of withdrawal, in accordance with Article L221-28 of the French Consumer Code. Any commission or subscription applicable to vendors is stated before subscribing and is subject to specific conditions.
6. Content and guests
You retain ownership of the content you publish (text, images, guest lists, messages). You grant the Publisher a limited licence, required solely to operate the Service, to host it, display it and transmit it to the people you designate.
You warrant that you hold the necessary rights over this content, in particular over your guests' data, which you process as data controller. Guests access their reply page through a personal link, without creating an account; you undertake not to share that link with third parties and to send invitations and reminders only to the people concerned.
Guest photo and video drop: the organizer who enables it is responsible for it. They choose who receives the link, moderate the files received (they can hide or delete them and block a contributor), decide whether to open a gallery to guests, and handle removal requests addressed to them. Files are permanently deleted seven days after the event; it is up to the organizer to download them beforehand.
Whoever sends a photo or video declares that they took it or have the right to share it, and that the recognizable people in it agree to appear (image rights). Unlawful, violent, sexual or hateful content, or content that invades someone's privacy, is forbidden. The sender remains responsible for what they send, and allows the organizer to keep it and the Publisher to host it for the duration of the drop. The Publisher does not review files before they are delivered; it promptly removes any manifestly unlawful content reported to contact@etkivent.io.
Unlawful or misleading content, content infringing third-party rights, and any use of the Service for unsolicited canvassing, bulk extraction of the directory or circumvention of its security measures are prohibited.
7. Artificial intelligence
AI plan generation produces suggested steps, tasks and vendor categories from the information you enter. These suggestions are provided for guidance only: you review them, edit them and decide what is saved. The Publisher does not guarantee their completeness or suitability for your situation.
The information sent to the model is limited to the event description you write for that purpose; it is not used to train the provider's model.
8. Availability and changes
The Publisher strives to provide continuous access to the Service but does not guarantee any availability. Interruptions may occur for maintenance, updates or external causes. The Service evolves regularly; features may be added, changed or removed without giving rise to compensation.
9. Liability
To the extent permitted by law, the Publisher's liability is limited to direct and foreseeable damage resulting from a proven breach of its obligations, and shall not exceed the amounts, if any, paid by the user to the Publisher over the last twelve months.
The Publisher is not liable for disputes between organizers, event planners and vendors, for event cancellations, for a vendor's failures, or for damage resulting from incorrect information entered by a user or from unauthorized access due to the user's negligence.
10. Suspension and termination
You may delete your account at any time from your profile or on request to the address given in the legal notice. The Publisher may suspend or close an account in the event of a breach of these Terms, fraud, non-payment or a threat to the security of the Service, after notice except in urgent cases.
Accounting data (quotes, invoices, payments) is kept for the legal retention period even after the account is closed. Ongoing events and accepted booking requests remain accessible to the other parties until they end.
11. Governing law and mediation
These Terms are governed by French law. In the event of a dispute, the parties shall seek an amicable solution; failing that, the competent courts are those of the Publisher's registered office, subject to the protective rules applicable to consumers.
In accordance with Articles L611-1 et seq. of the French Consumer Code, any consumer user may use, free of charge, the consumer mediator to which the Publisher belongs, whose contact details are provided on request at contact@etkivent.io, after sending a written complaint to the Publisher that has not received a satisfactory answer within two months. The European online dispute resolution platform is available at ec.europa.eu/consumers/odr.
The Publisher may amend these Terms; the version in force is the one published on this page, with its update date. Substantial changes are announced by email or in the Service at least fifteen days before they take effect. Continued use of the Service after publication constitutes acceptance.
